The extensions. It was agreed that for the first three years of application of the reform, the duration of the appeal process extends for a further year and that of the cassation trial for a further six months. Therefore, extensions are foreseen for crimes of mafia association, mafia political exchange, association aimed at drug dealing, sexual violence, crimes with the purpose of terrorism and subversion of the democratic order. The Appeal and Cassation judges may by order, motivated and appealable in the Cassation, order the further extension of the trial period in the presence of certain conditions regarding the complexity of the process, the number of parties and charges, the complexity of the issues of fact and of law.
Effective date. The reform only involves crimes committed from January 2020 and will enter into force step by step, following the publication of the law in the Official Gazette, so as to allow the judicial offices to manage the transformations. In fact, for the first three years, by 31 December 2024, the terms will be longer for all processes (three years on appeal, one year and six months in the Supreme Court). There is the possibility of a total extension, up to four years on appeal (i.e. three years and one extension) and up to two years in the Supreme Court (one year and six months, plus six months of extension) for all ordinary trials. The possibility of extending the maximum duration of the process is limited to one time only.
