Approved the rules against unfair practices in agri-food business relations

ICQRF designated national law enforcement and supervisory authority

The art. 7 of the European Delegation Law which defines the all-inclusive discipline against unfair practices in the agri-food chain for the protection of entrepreneurs and consumers.

The principles identified by the Italian Parliament make it possible to direct the existing legal framework towards greater protection of operators in the agricultural and food supply chains with respect to the problem of unfair practices. Therefore, good commercial practices and the transparency that sellers and buyers of agri-food products must comply with before, during and after the commercial relationship will be supported.

The aim is to prohibit excessively burdensome commercial practices for agricultural and food producers, such as double-discount electronic auctions and sales at prices 15% lower than the average production costs elaborated by Ismea.

The Central Inspectorate for the protection of quality and anti-fraud of agri-food products (ICQRF) will also be designated as the national law enforcement authority responsible for supervising the application of the provisions governing commercial relations, the application of prohibitions established by the directive and related sanctions. Alternative dispute resolution mechanisms between the parties will also be introduced, enhancing the role of representative organizations through the definition of national framework agreements.
