Cassation judgment on the Rackete case, Admiral De Felice: "offense to all the Armed Forces"

The Cassation has dismissed the appeal presented by the Prosecutor of Agrigento against the lifting of house arrest. Instead, according to the judges of the Court, the decision was correct because the necessary requirements to justify the measure were lacking. The appeal to the Supreme Court was promoted by the prosecutors Luigi Patronaggio and Salvatore Vella, against the revocation ordered by the investigating judge Alessandra Vella, who on 2 July decided not to validate the house arrest, despite the security decree bis by Salvini.

The decision of the Cassation was commented by the divisional admiral - Navy reserve - Nicola De Felice:

"The sentence of the Court of Cassation of Palermo on the Rackete case leaves me amazed at the failure to comply with previous judgments issued by the Court itself, for similar cases related to the failure to comply with GDF warships. Warships, specifies the admiral, they are responsible for public order in Italian territorial waters, the decision of the Supreme Court offends all the Armed Forces that daily put the lives of their men and women at risk in defense of the national interests of a people, the Italian one, which had a democratically elected government. If a state with a democratic legal system fails to protect its national interests, it is unable in the long run to preserve the freedom of its citizens.".

For the Court of Cassation, the revocation of the arrest towards Carola Rackete, the captain of the Sea Watch 3accused by Salvini of violating international waters.

Now the Cassation has rejected the appeal filed against the revocation of the measure and confirmed that there were no conditions for its application, given that the offense had been committed as "fulfillment of a duty", that of save lives human.

Matteo Salvini's reaction is immediate and instead risks a sentence for kidnapping for the case Gregory, another ship that rescued 130 migrants last summer.

The Immunity Board will vote on 20st January the report of Maurizio Gasparri who says no to the request for authorization to proceed against Matteo Salvini within the case Gregoretti. The Board for the Regulations, in fact, approved the agenda presented by the League which provides for a derogation from the peremptory nature of the 30-day deadline (expiring today) granted to the Board for Immunities to arrive at a decision on the request for authorization to proceed for a member of Palazzo Madama.
