Musumeci Government clash: "The Tar will decide"

Musumeci has therefore issued an ordinance which provides for the eviction of all collapsing Sicilian hotspots.

President Musumeci complains that Sicilians are forced to wear masks and keep their distance, while immigrants are forced to live in hotspots without observing any precautions, thus creating new dangerous outbreaks. The problem is not the migrants but the precarious health conditions in which they are forced to live. The hotspots are on the verge of collapse, accommodating over ten times their reception capacity. The conditions are really prohibitive for both guests and those who work there.

A big grain for the government which in these hours is facing the resurgence of the coronavirus but also the problem of opening schools.

The reaction of the Ministry of the Interior was immediate, which deems Musumeci's ordinance of no value since the problem concerns security and migrants, which are the responsibility of the ministry. Musumeci then called the government to its responsibilities: "If that is your responsibility, you are outlawed because there is no guarantee of safety there. It is my duty to protect health and I move on. Nobody can think of campaigning, haute cuisine actions ”.

In this regard, Musumeci specified: "Sanitary competence in times of epidemics lies with the President of the Region. I moved only according to my competence, we will see what the judiciary will decide if my order should be challenged "

The way to "cancel" the order will therefore be recourse to the TAR, with a request for suspension, or to the Constitutional Court for a conflict of attribution. 

Governor Musumeci, as already done on other occasions, will probably also appeal to article 31 of the special statute of the Sicilian Region which reads: "The maintenance of public order is provided by the President of the Region by means of the State Police, which in the Region depends disciplinarily, for the use and utilization, by the Regional Government. The President of the Region can ask for the use of the armed forces of the State.However, the State Government may take over the direction of the public security services, at the request of the Regional Government, jointly with the President of the Assembly and, in exceptional cases, on its own initiative, when the general interest of the State and its security are compromised. ".

Corriere della Sera reveals part of the text of an unpublished letter sent by Prime Minister Conte to Musumeci last July 30 on a similar issue to which reference was made to art. 31 of the Sicilian regulation. "The alignment, albeit partial, as you well know, of the Statute of the Sicilian Region with the Constitution, was carried out with the Constitutional law of 26 February 48 ”. The premier lawyer thus reminds Musumeci of the unconstitutionality of his line.

The interlocutory proposal could be that to send more ships to accommodate the surplus migrants on the island. What is certain is that this does not solve the health problem because the problem, complained by Musumeci, would move from the mainland to a hospital ship. A tent city is also proposed in the former military area of Vizzini. Rejected by Musumeci: "we create concentration camps, which we call tent cities, in a military depot in Vizzini, abandoned for years ”.

Apparently the only solution is to turn to administrative justice even if the sanitation problem raised by Musumeci remains.
