Justice. New regulation on wiretapping

New discipline of wiretapping 60 million invested by the Ministry of Justice Bonafede: "it was not a zero-cost reform, we will minimize any application difficulties"

From today, the new regulation of wiretapping dictated by the legislative decree 29 December 2017, n. 216, as amended by the decree-law of 30 December 2019, n. 161, converted with amendments by law February 28, 2020, n. 7.

At the end of a process started in 2018, the Ministry of Justice completed the organizational, training and technological development activities necessary for the implementation of the legislation. Activities that did not stop even during the COVID-19 emergency.

The latest operational indications were conveyed to the judicial offices with a note last July 20 and, more recently, with a circular of August 31.

Furthermore, a permanent table on the new discipline is active at the Ministry, which involves the main public prosecutors. The first operational meeting was held on August 25th.

The work that made it possible to obtain this important result concerned six areas of intervention:

  • Adaptation of IT systems;
  • Adaptation of dedicated premises and purchases;
  • Strengthening of physical security;
  • Dedicated training;
  • Organizational-logistic meetings and indications;

Monitoring of the activities carried out.

“It was not a cost-free reform and we moved in time in order to minimize the inevitable difficulties in applying the new discipline”, comments the Minister of Justice Alfonso Bonafede. “From today, a new phase comes into force for a fundamental investigative tool such as wiretapping. The Ministry will remain in contact with the Prosecutors and the Advocacy to collect reports on any critical issues that may arise and prepare the related solutions ".

Some data in summary:

  • the Ministry has set up 140 Telecommunications Interception Center (CIT) rooms with dedicated network and dedicated wiring and equipment of portable PCs. The ministerial server was also installed in each CIT room and the software for the management of the multimedia digital archive and for the document archive was created;
  • 60 million euros are investments already spent on technological infrastructures, masonry works and the necessary purchases;
  • 700 servers and racks dedicated to wiretapping only;
  • over 1100 PCs dedicated and intended for listening rooms;
  • about 3.500 people involved in specific training (administrative staff, magistrates and judicial police).

The immediate future sees the offices involved undoubtedly called to the challenge of also renewing the organizational logic and workflows. Training will therefore start in all public prosecutors from 10 September, with the provision of support for organizational management.

Also in order to support this path, the following initiatives are noted:

1) the application start-up phases of the new discipline will be accompanied by the offer of constant assistance by the Directorate General for Automated Information Systems (DGSIA) and the Directorate General for Material Resources and Technologies, for the activities of their respective competence;

2) DGSIA is providing the 140 Public Prosecutors with specifically dedicated assistance personnel;

3) dedicated training will continue, also through specific meetings and webinars open to the personnel of the judicial police, according to indications that will be offered by the competent directorates general (Personnel Management and Information and Automated Services Directorate);

4) operational / organizational meetings with the Department will resume in order to verify how to solve the logistical and work problems that the start of the new discipline could entail. In these meetings, the needs of the Court and Juvenile Justice offices will also be verified at the start of the new discipline;

5) an operational group will soon be set up with the participation of some representatives of the Prosecutor's offices, which will discuss with the DGSIA on the necessary developments of the IT system, also with a view to a rapid approach to the fully digitalized management of the procedure;

6) specific sessions will also be dedicated to the Advocacy, through discussion in the "Permanent Helpdesk for Telematic Justice", established with the protocol signed last 23 July.
