War against the NGOs, so the Government with the Italian Minister of the Interior, Salvini, tries to oppose the activity of "suspicious" boats, towards the Italian coasts.

"They are offensive because they prejudice peace, good order and the security of the state; seal the territorial waters to the unpleasant means like those of the NGOs". With this observation Salvini would like to impose the "naval blockade" in the Mediterranean which, however, to be decreed requires a preventive ordinance that declares "the state of danger".

The procedure is, however, an obstacle course both because of the discontent of the left wing of the M5S, and because the decree must pass through the Quirinal's scrutiny.

Also the UN Convention on the Rights of Navigation which was signed in December 1982 in Montego Bay, Jamaica, by 155 States provides in article 19 the reasons why the passage of ships is to be considered harmless and when it can be prevented. The art. 19 states that the passage is "detrimental if the ship is engaged in activities of threat or use of force against the sovereignty, territorial integrity or political independence of the coastal state".

On this point will probably move the Government that intends to oppose the NGOs in the rescue of migrants. The dispute will also include the dictation of the art. 17, of the same convention. In particular, the rule "prohibits the passage in case of loading or unloading of materials, currency or people in violation of the laws and customs, tax, health or immigration regulations in force in the coastal State ".

Naval Block

National patrol vessels, if there is a ship in international waters heading towards Italy, will have to escort it outside the borders. In the provision Salvini would refer to article 650 of the penal code which punishes the non-compliance with a provision of the authority for crews and NGO managers who do not have to respect the prohibition to enter Italian waters.

No Australian Way

The intention of the Italian government would be to be inspired by the migrant policy in Australia.

In fact, it is not possible to enter Australia illegally. Unauthorized vessels that are intercepted in Australian waters are rejected and escorted back to the ports of departure. Those who are not recognized as asylum seekers or refugees, on the other hand, are transferred to identification centers on the island of Nauru or Papua New Guinea pending examination of any asylum applications.
