ACN: The Italian Cybersecurity Agency

The National Cybersecurity Agency (Acn) was born, provided for by a decree, still under 19 articles which, already presented to Copasir by the Undersecretary for Services Franco Gabrielli, was given the go-ahead by the Council of Ministers. According to the decree, in addition to the Acn, an interministerial committee for cybersecurity is set up at Palazzo Chigi "with the functions of consulting, proposing and deliberating on cybersecurity policies, also for the purposes of protecting national security in the cyber space ". The decree also establishes that the Prime Minister is exclusively assigned: “top management and general responsibility for cybersecurity policies; the adoption of the national cybersecurity strategy, after consulting the Interministerial Committee for Cybersecurity; the appointment and dismissal of the general manager and of the deputy general manager of the ACN. Functions that the head of the government can delegate, in the exercise of his functions, to the undersecretary for services. The Agency, according to the draft of the text, "has a legal personality under public law and is endowed with regulatory, administrative, patrimonial, organizational, accounting and financial autonomy". The decree provides for the recruitment of ad hoc personnel for the Agency, even if not from the Public Administration. In the first application, the organic endowment of the ACN is three hundred units. But, according to the decree, the Agency is destined to grow up to eight hundred units in 2027. The budget for the Agency is not yet indicated in the draft. Another novelty is the Cybersecurity Nucleus, set up at the ACN, of which it constitutes a sort of front line which, in crisis situations, ensures support for the Prime Minister and the Cisr. The Nucleus is made up of the Prime Minister's Military Advisor, a representative, respectively, of Dis, Aise, Aisi and each of the Ministries represented in the Interministerial Committee for the Security of the Republic (Cisr). It also includes a representative of the Ministry of the University, the Minister delegated for technological innovation and digital transition, and a representative of the Civil Protection Department of Palazzo Chigi. The director of the ACN himself presides over the Nucleus. Finally, the decree governs some changes to the 2018 legislative decree with which the government implemented the EU Nis directive on cyber security.
