Valditara: “Satisfied with the Council of State decision. We continue to work towards the implementation of the reform"

Yesterday the Council of State, with a monocratic precautionary decree, accepted the appeal of the Ministry of Education and Merit immediately proposed, through the Attorney General, against the order of the Campania Regional Administrative Court of 30 October.

The Council of State, in particular, highlighted how in the comparison between the opposing interests it is necessary to suspend the enforceability of the ordinance of the TAR Campania as its execution would irreversibly prejudice the administrative procedures currently underway in all the Italian regions for allow the correct sizing of the school network and, therefore, the regular start of teaching activities in compliance with the timescales imposed by the obligations assumed by Italy at European level.

''We welcome with satisfaction the decision of the Council of State which has re-established order - after the ruling of the Campania Regional Administrative Court - in the context of the disputes promoted by some regions against the PNRR school sizing plan. Furthermore, the decision confirms a favorable jurisprudential line already resulting in the recent decision of the Lazio TAR on the precautionary application of the Puglia Region. As we have always said, we remain convinced of our reasons and confident in the work of the judiciary. We now await, with the same confidence, the judgment of the Constitutional Court. In the meantime, strengthened by the decision of the Council of State, we continue to work without interruptions on the implementation of a reform that Europe is asking of us and which will be able to harmonize the administrative management of our schools".
