Salvini is formally investigated for kidnapping, illegal arrest and abuse of office, together with his Chief of Staff. The sending of the file to the court of ministers of Palermo is foreseen by the constitutional law 16/1/89 n. 1.
The turning point in the investigation came after the interrogation of the head of the Department for Civil Liberties and Immigration, Gerarda Pantalone, and his deputy Bruno Corda at the Public Prosecutor's Office of Rome. Both prefects heard as witnesses. The prosecutor Luigi Patronaggio and the substitute Salvatore Vella have reconstructed the chain of orders that reached the commander of the Diciotti ship and decided to register the head of the Interior Ministry and his head of cabinet in the register of suspects.

That there is "nervousness" between the Prosecutor of Agrigento and the Minister of the Interior and Vice Premier Matteo Salvini, it was understood also by the statement of the ANM (National Association of Magistrates), in peremptory tones where the activity of the magistrates is defended .
“These days the Public Prosecutor's Office of Agrigento - reads the note from the National Magistrates Association - is carrying out the necessary investigations to verify whether crimes have been committed in the delicate affair of the Diciotti ship. Unfortunately, we note that, speaking of the affair, the Minister of the Interior has issued declarations aimed at orienting the development of the investigations with regard to the potentially responsible subjects. This is an interference in the prerogatives of the Judicial Authority, the only institution to which the Constitution and the laws of the State attribute the task of verifying the existence of crimes and ascertaining and establishing who is responsible for them. No other person can take the place of the magistrates, nor suggest or dictate the judicial paths to follow, not even a member of the Government, who has the institutional duty to respect the constitutional prerogatives of the judiciary, which, it is good to reaffirm it once again, does not waste money public, as has been declared, but exercises jurisdiction by applying the law in line with the principles established by the Constitution ”. The ANM hopes that these episodes "do not continue and will ensure that every single magistrate, today the colleagues of the Agrigento Prosecutor's Office, in the future all the others, can carry out their duties in absolute autonomy, without inadmissible and undue interference".
The action of the judiciary is a must for the type of crimes contested and came on the day when the Ministry of Foreign Affairs and the Interior began to unblock the story of the Diciotti ship. 17 migrants who were made to disembark "by authority" by the ministry of health, due to health problems. Many of them are suffering from tuberculosis and pneumonia.
Then in the late afternoon the news that Albania will take 20 migrants, as a sign of gratitude to Italy for the help received in past years. Another 80 will be divided between Ireland and the CEI. In this regard, Prime Minister Giuseppe Conte thanked Ireland and the CEI. Basically 20 will go to Albania, 20 to Ireland and 80 to the CEI, spokesman Don Ivan Maffei told Ansa.
The Minister of the Interior Salvini and the government are, therefore, trying to relocate migrants to non-EU countries. A clear signal to the countries that yesterday in Brussels did not accept Italy's requests by disregarding the agreements at the end of June (relocation of migrants between EU countries, on a voluntary basis). Brussels should have found a structural solution to the problem, which the Italian government has always shown to be a European problem.
With the latest developments, the scenario begins to get complicated, as the Italian government is turning its position towards the European Union at 360 °. The yellow-green government has also leaked the fact that it could veto the contribution, or revise the amount of the 20 billion euros that Italy pays each year to the EU budget.
A situation, therefore, very delicate for Italy that is likely to be placed under cross attack with spreads from "friends" European partners (France and Germany in the lead). Donald Trump could run to the rescue of Italy, who during the recent meeting with Prime Minister Giuseppe Conte, said he was ready to buy part of the Italian public debt. Difficult to implement since the US does not hold a sovereign fund.
Donald Trump's move would aim to issue a clear warning to Germany and France that in recent times they have moved away from their long-time ally overseas. (France for foreign policy in Africa and Germany for interest in Armenian gas and not in American gas).
However, the whole story demonstrates the fragility of the whole European Community system.
Most likely the Italian ship Diciotti will be remembered in history for having generated epochal changes in the international arena.
On the horizon, in a “liquid” scenario, we see an Italian internal political crisis and a “dangerous” crisis in the vacillating European Union which still struggles to find its own truly community identity.
