Year-end chaos for the first Meloni maneuver. Among the measures cut to smart working

A chaotic end-of-year manoeuvre, with the vote of confidence in the Chambers and the technicians of the Mef (Giorgetti's department) who do not collaborate. Between realignments of the tables and the search for roofing, the first of the Meloni government is to be forgotten net of the few measures that can be implemented due to the absorption of most of the resources (21 billion euros) from expensive energy and inflation.

After tour de force in the Chamber, the text of the maneuver will pass to the Senate to be approved by December 29 and thus avoid the provisional exercise.

The hopes up were left unfulfilled Woman option, amnesty of tax crimes and Citizenship Income. And which have triggered a harsh controversy on the part of the oppositions, from which the accusation against the majority of bringing up to the last amendments started, but also by the president of the Culture commission, Federico Mollicone (FdI) who directly accused on TV officials from the Mef and the Accounting Office to be absent during the second night of work in the commission.

"They have worked so hard, they are all tired“, the Economy Minister replied in Transatlantico, Giancarlo Giorgetti, defending the MEF officials who, beyond attendance, have always been connected up to the last vote in the commission.

In the end, however, the approximately 600 corrections approved by the commission did not upset the structure of the first maneuver by the Meloni government, which allocates over 85% of resources to support families and small businesses against high energy costs and inflation .

On pensions comes 103 quota, while the tax authorities are dominated by both the 12 regularizations, ranging from the one on good-natured notices to the disputes in the Cassation, and the two flat taxes. Then there is the wedge cut which rises to 3% for workers with incomes of up to 25 thousand euros and the tightening on smart working.

The Government has confirmed the payment of the 500 euro bonus to those born in 2004 who turned 18 this year. There is also food income, a mini Sabatini for businesses and the refinancing of the bonus for investments in the South with over 1,5 billion drawn from the cohesion funds.

But there is also the much-contested rule on wild boar hunting in cities, starting from metropolitan areas. However, the so-called unfinished projects also remain in the spotlight.

According to what Il Sole24Ore writes, the government has currently renounced the extension on Option woman. The collection of excerpts of the folders will take place only with the ok of the Municipalities. The mechanism for canceling mini-files of up to one thousand euros entrusted to collection from 2000 to 2015 has been revised. Credits pertaining to local authorities and private social security institutions will be canceled only if a resolution is adopted by 31 January 2023 The automatic cancellation will be limited to the sums due by way of interest for late registration, penalties and default interest but will not apply to the capital due for the amount accrued as reimbursement of expenses for enforcement and notification procedures of the payment slip. For administrative sanctions, including those for road fines, the cancellation will only concern the interest and not, however, the sanctions and the reimbursement of the costs for the enforcement and notification procedures, which must in any case be paid by the debtor.

Smart working the communication to the Ministry of Labour

For private employers, excluding contracting agencies, notification to the Ministry of Labor of the start of smart working must be made within 5 days of its effective date. The ministry confirms this in a Faq published on 23 December.

Article 23 of Law 81/2017, in the version renewed by Legislative Decree 73/2022, from 1 September 2022 does not contain any time reference for compliance, but the ministry, in a statement dated 26 August 2022, had identified the deadline in the 5 days following the start, assimilating the agile work performance to a change in the employment relationship which, as such, must be communicated within 5 days of the respective effective date. Since the rule has not been integrated and since September there have been three extensions to carry out this fulfilment, the ministry reiterated that the 5-day term starts from the beginning of the agile work performance or, in the event of an extension, from the last day of the previously communicated period.

The confirmation arrives a few days before the deadline, set for 1 January 2023, within which to make the communication according to the new methods that should have been fully operational from 1 September, but which have been repeatedly extended.

Since the Faq refers only to new agreements or extensions, the 5-day deadline should not apply to individual agreements already stipulated and starting from 1st September last (or later) which have not yet been communicated, as they have benefited from the postponements of the notification obligation. For these agreements, the deadline should not be postponed from 1st to 6th January.

For public employers and temporary agencies, on the other hand, the communication deadline is set for the 20th of the month following the start of smart working, or in the event of an extension, the end of the previously communicated period.

Smart working only for the frail

The 2023 budget maneuver provides for the reduction of the categories that will be able to work in smart working.

The amendment expressly states that fragile workers will be able to continue to work in smart working both in the public and in the private sector, until 31 March, who will also be able to perform another job. The amendment to the maneuver was approved in the House Budget Committee and no reference is made to parents of children under 14.

Fragile workers are those who result from medical certification, immunosuppressed, cancer patients, with ongoing life-saving therapies, or seriously disabled. Reference decree of the Ministry of Health of 4 February 2022.

For fragile workers, therefore, facilitated smart working continues to be applied, i.e. without the obligation of an individual agreement.

Mode that, in view of the deadline on December 31st, has not been renewed for workers with children under 14. From 1 January 2023, this category will therefore fall under the standard smart working legislation which provides for the obligation of an agreement between company and worker or company and trade unions.
