Yesterday the Council of Ministers approved the decree law on the cybernetic national security perimeter. The provision is based on a system to guarantee the highest level of protection to public administrations, national, public and private entities and operators from cyber attacks. A system that, in essence, will have to protect the national strategic apparatuses.
The novelty of the decree is the exercise of special powers in relation to networks, information systems and strategic broadband communication services based on 5G technology with a protection procedure also for the Italian Stock Exchange. The provision, however, refers to a series of implementing decrees that will entail many problems as regards their application. The dangers to state structures from cyber attacks were reported several times by the organ of the Prime Minister, the Dis - Information and Security Department. Other departments are also interested in the new prevention and contrast system: Ministry of Economic Development, Interior, Defense, Foreign Affairs, Treasury and Agid - Agency for Digital Italy.
The modus operandi is clear: "it is essential to always communicate a cyber attack and to monitor entities outside the administration, interested in various ways to work on information systems". The novelty is the penalties for those who do not comply with the new prevention rules: from a minimum of 20 thousand euros up to 1,8 million, with imprisonment of up to five years for omitted or false communications before checks and investigations. The control body is the CVCN, national assessment and certification center at the Mise. The same Mise will carry out inspections and checks on private subjects, the Agid on public ones. An operational role is played by the CNAIPIC, the national computer anti-crime center for the protection of critical infrastructures of the Ministry of the Interior at the Postal and Telecommunications Police. The Ministry of Defense will be responsible for digital procurement.
